Pune Doctor and Wife Face Legal Trouble for Alleged Encroachment on Sealed Property

Pune A Police case has been registered against Dr. Manoj Uddhav Nichal (55) and his wife, Sushma Manoj Nichal (50), residents of Gokulnagar in Kondhwa Budruk, for allegedly encroaching on a flat that was sealed by a credit institution. The incident transpired between March 30, 2022 and June 8, 2023, prompting the Sriram Nagari Credit Institution to file a complaint with the Kondhwa Police Station.

Sagar Bhagwan Vedpathak (38), a special recovery and sales officer at the credit institution, lodged the complaint against the couple and two unidentified individuals. The case has been registered under IPC sections 441 and 447.

According to police reports, the accused couple had availed a loan of Rs 15 lakh from the credit institution, pledging their income as collateral. However, the couple failed to make a single instalment payment, prompting the credit institution to take legal action to recover the overdue loan.

According to orders issued by the Bombay High Court, District Sessions Court Pune, Collector, and District Magistrate Pune mandated the credit institution to seize the income of the accused and subsequently seal and lock the property. Despite these legal measures, the accused broke the seal and lock and started living there, encroaching on the property in violation of government orders.

Sagar Vedpathak, the plaintiff in the case, serves as a special collection and sales officer at the Sriram Nagari Credit Institution. The institution had followed due legal processes to recover the outstanding loan, making the encroachment by the accused a breach of established legal procedures.

Assistant Police Inspector Usgaonkar is leading the investigation into the alleged encroachment.
