Pune News | No registration of 1-2 guntha land, rules Supreme Court

PUNE: Pune News |  Despite the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, land was divided into small pieces and were being registered. Since the irregularities came to light, a circular had been issued which stated that if such lands are to be purchased and sold, a layout should be prepared of the area and the permission of the collector or a legal authority should be taken.

 

 

The Aurangabad bench of Bombay HC had issued orders cancelling the circular. The Stamp and Registration Department had approached the SC against the HC ruling. The SC has stayed the HC ruling for two months. Hence, it became clear that the registration of fragmented land will not take place for two months. The Stamp and Registration Department had issued a circular on July12 according to section B of The Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act.

 

The circular stated that while carrying out transactions of 1 to 3 guntha land, a layout should be made of the concerned area and permission should be taken of the collector or a legal authority before registration. The HC had given a ruling cancelling the circular. Later, the Stamp and Registration Department had filed a review petition. After a hearing was held, the HC upheld its earlier ruling. It gave orders cancelling the circular in April. The department had approached the SC. The state government’s counsel argued in the SC that if registration of fragmented land takes place, it will not lead to development of a planned city, and will lead to proliferation of illegal constructions creating more problems. The SC accepted the arguments of the counsel and stayed the HC ruling for two months.

 

“The SC has accepted the arguments of the Stamp and Registration Department and stayed the HC ruling. A suitable action will be taken to make necessary changes in the Act,” said Inspector General of Registration and Controller of Stamps Hiralal Sonawane.
