High court: Not amount to rape, if failed to marry after consensual sex

NPnews24 Online, Bhopal: The Madhya Pradesh High Court quashed a ‘rape case’ against a man on the ground that the consent for sex was granted by the prosecutrix even after knowing very well that the accused would not marry her.

The court found that prosecutrix was ‘deeply in love’ with the ‘accused’ and wanted to remain in his company. Justice SK Awasthi observed that the prosecutrix cannot turn around and claim the consent was based on misconception.

The court referred to a recent Supreme Court Judgement (Dr. Dhruvaram Murlidhar sonar vs. State of Maharashtra) in which it held that if a person had not made the promise to marry with the sole intention to seduce a woman to indulge in sexual acts.
