“The business of selling food items at multiplexes and theatres is incidental business and not the main business which is screening films, unlike a restaurant which has food sale/serving as main business,” Said a division bench comprising Justice Ranjit More and Justice Anuja Prabhudesaai while hearing a petition filed by one Jainendra Baxi seeking patrons to carry outside food in theatres.

The Bombay High Court on Wednesday questioned the Maharashtra government’s stand to not allow outside food inside multiplexes, citing security reasons.

“Is the food not for personal consumption by patrons? How can it cause a security threat?” asked HC after the government saying it can create security issues.

The bench also added, “In cinema halls, there are metal detectors to check those who enter. If food is allowed to be taken inside by flyers, why can’t they do the same in multiplexes? How will there be a security breach? The state government affidavit has not specified in what way will it be a security threat? There has to be some reason given.”

The government claimed in an affidavit that as per the rules it cannot allow people to carry outside food items, but it will direct multiplexes to ensure water and packaged food items are not sold above MRP.

Earlier, on Tuesday, Food and Civil supplies Minister Girish Bapat had declared a special cell that will check the price of the water bottles and cold drinks sold in multiplexes and Malls. This special cell will not just check the price of the food and product but also the weight of the packaged food, name of the producer and address, date of production, expiry date.
