VM Group’s Vijay Tapadia directed to give parking space ownership to flat owner in Ambegaon
Pune : NpNews24 Online – Pune News | A consumer forum provided relief to a flat owner who did not get the parking space promised in the agreement. “The flat owner should be given the parking space ownership as per the agreement,” directed the forum.
Additional District Consumer Grievance Redressal Commission Chairman JV Deshmukh, Members Anil Javalekar and Shubhangi Dunakhe gave this verdict.
A complaint was filed before the commission by Hemant and Jyoti Jagtap against VM Group’s Vijay Tapadia. The Jagtaps had booked a flat valued at Rs 32.49 lakh in a housing project undertaken by the builder in Ambegaon. An agreement was signed, in which it was mentioned that they would also get parking space.
However, they were not issued the completion certificate while giving possession of the flat. Hence, they lodged a complaint against the builder with the police and the commission, stated the verdict.
Adv Dnyanraj Sant and Adv Jayashree Kulkarni argued before the commission on behalf of the plaintiff. The Jagtaps had demanded compensation of Rs 5 lakh for mental and physical hardships, Rs 50,000 expenditure on account of filing of the complaint and Rs 5 lakh for not getting the promised parking space.
The commission directed the builder to give possession of the parking space within 45 days. He has been directed to pay the couple Rs 15,000 for causing inconvenience in parking, Rs 10,000 for mental and physical agony and Rs 10,000 on account of expenditure for filing the plaint.
