No Ban on Fire cracks: Burn green crackers from 8pm to 10pm

NEW DELHI: NP NEW 24 ONLINE – Supreme Court gives verdict the firecracker ban on Tuesday. It refuses to place a nationwide ban on the sale of firecrackers. In its verdict today, the court said only ‘green firecrackers’ or eco-friendly (which are less polluting) will be allowed to be sold.

No online sale

In its decision, it also banned the online sale of firecrackers and put a stay on e-commerce company which was selling firecracker.

8 pm to 10 pm

SC has also decided the timings of the for burning the crackers. The court said people will be allowed to burn crackers between 8 pm and 10 pm on Diwali. The SC also decided the timings of other festivals for burning crackers on New Year and Christmas, the timing is from 11:45 pm to 12:15 am.

The bench had earlier said that there was a need to strike a balance between the right to health and the right to carry on a trade or profession. The matter was heard by a bench of Justices AK Sikri and Ashok Bhushan. On August 28, the bench had reserved its verdict.

It had also said that there was a fundamental right to livelihood of firecrackers manufacturers as well as the fundamental right to health of 130 crore citizens of the country.

The court has also directed all states to explore the feasibility of community cracker bursting during festivals.

“The question is whether an entire industry can be shut down citing air pollution while other industries are allowed to continue,” the five firecrackers manufacturers had contended.

The Supreme Court’s verdict came in response to a plea seeking a ban on the manufacturing and sale of firecrackers across the country to curb air pollution. This comes 15 days ahead of Diwali (November 7).
