Pune Crime News | Even after getting bail, youth from Nepal spends six years and 10 months in jail

PUNE : Pune Crime News | A youth from Nepal was arrested for planning to commit dacoity. After he was granted bail by the court, he had to spend six years and 10 months in jail. Pune District Legal Service Authority’s (PDLSA) public protector office did a follow-up and the youth was released after an application was made in the court. The orders about the youth’s release were issued by Addl Sessions Judge DV Kashyap.

 

Rakesh Thapa had been arrested while he was about to commit dacoity. Thapa hails from Nepal. After he was remanded in judicial custody, he was sent to Yerawada jail. He had made an application seeking bail and the court granted him bail. However, Thapa had not fulfilled the conditions set by the court. Hence, he had to spend six years and 10 months in jail.
The public protector office got this information and efforts were made to secure Thapa’s release.

 

An application was made by Ad HN Shaikh and Ad Madan Kurhe of the public protector office under the guidance of PDLSA’s secretary Sonal Patil. During the hearing, Thapa admitted his crime. After pointing out to the court that Thapa had spent many years in jail compared to his sentence, the court ordered his release on bail.

 

Ad Shaikh and Ad Kurhe argued in the court that Thapa’s bail had been approved. However, since he could not fulfil the conditions of the bail, he is in jail for six years and 10 months. It is his legal right to get bail and be freed from prison. It is necessary that he gets justice according to natural justice. They argued that considering his punishment and the time he has spent in jail, he should be permanently released. The court upheld the arguments and ordered Thapa’s release.
