However, he emphasizes that the Supreme Court has unequivocally distinguished between the real party and the legislative party, asserting that the actual party leadership remains with Sharad Pawar while the legislative group is led by Ajit Pawar.

 

Bapat further elaborated on the significance of the party’s constitutional standing, stating, “The Constitution of Sharad Pawar’s party is currently with the Election Commission, indicating that the real party structure remains under Sharad Pawar’s control. Elected officials derive their strength from the party, making the legislature party distinct from the real party.”

 

Highlighting the importance of voters’ choice, Bapat emphasized that constituents cast their votes for a particular party, aligned with its ideology and principles. He likened a legislator defecting from their party to severing ties with one’s own mother, highlighting the Supreme Court’s stance against such actions that sever the ideological connection between elected representatives and their party.

 

As the Election Commission now becomes the arbiter in this dispute, Bapat underscored the commission’s crucial role in determining the rightful leadership and ownership of the party symbol. He explained, “Ajit Pawar cannot unilaterally claim the party or its symbol. They must present their case before the Election Commission, which will then make the final decision on the legitimate leadership and symbol.”
