Pune News | Fursungi and Uruli Devachi not outside PMC limits, state government informs Bombay High Court

MUMBAI : NpNews24 Online  –  Pune News | The state government informed the Bombay HC on Monday that the villages of Fursungi and Uruli Devachi have not been excluded from PMC limits and the final notification about this has not been issued. The advocate general also assured the court that the final notification will be issued within the legal framework. (Pune News)

The March 2023 decision of the state government to exclude Fursungi and Uruli Devachi from PMC limits had been challenged by Ranjit Raskar and some others in the Bombay HC. The hearing on these petitions was held in front of the bench of Chief Justice Devendra Kumar Upadhyay and Justice Arif Doctor. Since the tenure of the civic body ended in February 2022, the civic chief had been appointed as the administrator and the decision to exclude the villages was taken by consulting him. According to the law, the state government cannot take such a decision without consulting the General Body of the PMC. The lawyers for the petitioners, Ad Pralhad Paranjpe and Ad Manish Kelkar, argued that the consultation with the administrator cannot be considered as legal.

However, the Advocate General, Birendra Saraf, informed the bench that the state government had not issued a final notification. He said that under 452 (A) of the Maharashtra Municipal Corporation Act, the administrator can take all decisions concerning the municipal corporation. The final notification has not been issued. Before it is issued, the state government will complete all legal formalities and if necessary, the petitioners will be given a chance to present their say, Saraf said. After Saraf’s statement, the bench disposed of the plea and instructed the petitioners to submit a memorandum to the PMC in 10 days.
