Pune Cooperative Court | Students cannot be denied permission to stay in cooperative housing societies, rules Cooperative Court

This is against the spirit of ‘city of knowledge’, says court in interim order

PUNE : Pune Cooperative Court | The Cooperative Court has delivered a jolt to a society which had made a rule that a flat owner cannot rent his flat to a student without the society’s written permission. The court has ruled that it is staying the society’s rule till it gives a final order. The court said that it will not be right to refuse giving a flat on rent to a student when Pune is known as the ‘Oxford of the East’.

 

The Vanraj Cooperative Housing Society had passed a proposal about giving flats to students on rent in a general meeting. As per this proposal, it was made compulsory for a flat owner to take the written permission of the society before giving his flat on rent to a student. Those who rented out their flats to students were issued notices giving them time till October 30, 2022 to evict the tenants. It was also decided that erring members will have to pay a fine of ₹10,000 per month.

 

The society’s decision was challenged in the Cooperative Court by flat owner Dnyanoba Atharmwar and others. A hearing was held in the court of Cooperative Court (No 2) of Judge AS Vanve in July 2023.

 

 

After hearing the arguments of both the parties, the court accepted the application filed by Atharmwar and others and issued a temporary order asking the society not to implement the rule.

 

Pune is considered an educational hub and lakhs of students come to Pune to pursue their studies. India’s first PM Pandit Jawaharlal Nehru had referred to Pune as the ‘Oxford of the East.’ Pune is undoubtedly the city of knowledge. If cooperative housing societies don’t give their flats on rent to students, it will go against the spirit of the ‘city of knowledge’, said Judge Vanve in his order.
