Nirbhaya Case : Difficult to Hang the Convicts Tomorrow, ‘This’ is the Reason

NP NEWS 24 : New Delhi : Just one day is left to hang the culprits of the Nirbhaya gang rape case. However, seeing the tactics adopted by them, it seems delay in hanging which was said to be on February 1. The reason for this is that except Mukesh, three other convicts have the option to send mercy petition to the President right now. The convicted Vinay has also sent his mercy petition to the President. If their petition is also dismissed from the President, then like Mukesh, all three can approach the Supreme Court for judicial review of this decision.

On behalf of lawyer of Nirbhaya’s accused, AP Singh, a petition has been filed in the Patiala House Court demanding that the date of hanging be extended once again. This time Delhi Prison Rules have been cited by the convicts. This petition has been filed on behalf of AP Singh, advocate for all four convicts of Nirbhaya. In this, the rules related to Delhi Prison have been cited. AP Singh referred to the provisions of Delhi Prison Rules in the petition, stating that none of the four convicts can be hanged under it till the last convict uses all the legal options including mercy petition.

Vinay’s mercy petition is pending
Earlier, Vinay had sent a mercy petition to President Ramnath Kovind on Wednesday. The curative petition of convict Vinay has already been dismissed. President rejected the mercy petition of the guilty Mukesh Singh on 17 January. The Supreme Court has also rejected the petition for judicial review of this decision. In such a situation, Mukesh has no option to avoid being hanged.

The current status of the four convicts
– Both curative petition and mercy petition of convict Mukesh Singh have been dismissed. Now there is no option left.

– The curative petition of convict Akshay Thakur has been dismissed. Now he has the option of mercy petition.

– The curative petition of convict Vinay Sharma has already been dismissed and he has sent a mercy petition to the President.

– Pawan Gupta still has both options. He can file both curative petition and mercy petition.

It will take more 74 to 75 days
Jitendra Jha, lawyer of Nirbhaya’s mother recently said in this case that right now I think it will take 74 to 75 days more. A new death warrant has been issued, but if any one files a mercy petition to the President before 12 noon on January 31, then the hanging will stop. The court issued a new death warrant for the culprits. However, the lawyers for the culprits are trying to pull the case further. Objections are being raised about the age of a convict. It is being said that he was not an adult at the time he committed the crime.
