Nirbhaya Case : Convict Pawan Gupta’s Curative Petition Dismissed by SC

New Delhi : npnews24 : The Supreme Court has dismissed the curative petition of Pawan Gupta, convicted of the 2012 Nirbhaya gangrape and murder. Pawan Kumar Gupta, one of the four convicts facing the death penalty in the Nirbhaya case, was left with the option of a curative petition which has expired. A bench of Justice NV Raman, Justice Arun Mishra, Justice RF Nariman, Justice R Bhanumathi and Justice Ashok Bhushan heard the curative petition in the chamber of Justice Raman. Three other convicts, including Pawan, are scheduled to be hanged on March 3. Pawan has requested to convert the hanging to life imprisonment, claiming himself to be a minor at the time of the crime.

Pawan, through advocate AP Singh, had filed a curative petition requesting the Supreme Court’s decision on the appeals and reconsideration petitions in the case. Advocate AP Singh has said that he has filed an application in the registry of the Supreme Court on Sunday requesting an oral hearing on Pawan’s curative petition in the open court. Among the convicts, only Pawan now has the option of filing a corrective petition.

On December 16, 2012, a medical student was gang-raped in a moving bus in south Delhi and was thrown out of the bus after the convicts gang-raped her. She died a fortnight later. Pawan and another convict Akshay Singh also requested the lower court to stay the execution of the death warrant. The lower court issued notice to the Tihar jail administration on the petitions and directed the officials to file their reply by Monday. Akshay has claimed that he has filed a new mercy petition before the President which is pending, while Pawan has said that he has filed a corrective petition before the Supreme Court.
