Husband responsible for every injury inflicted upon his wife: Apex Court

The Supreme Court on Monday rejected the anticipatory bail plea of a man who beat his wife, saying that the husband is responsible for the injury caused to the wife at the in-laws’ house. The Supreme Court has said that even if the injury was caused by another relative, the husband will be held responsible for it. This is the third marriage of a man accused of assault, while the woman has a second marriage.

According to reports, the couple gave birth to a baby boy in 2018, a year after they were married. In June 2020, the woman lodged a complaint with her husband and in-laws with the Ludhiana police. The woman alleged that she was beaten brutally by her husband, father-in-law and mother-in-law for not meeting the demand for dowry.

When the man’s lawyer, Kushagra Mahajan, sought his client’s anticipatory bail, a bench headed by Chief Justice of India SA Bobde said, “What kind of man are you”

The woman alleged that her husband was going to strangulate her. She has been accused of abortion. “What kind of person are you who beat your wife with a cricket bat?”, CJI said.

When the lawyer said that the woman herself had alleged that her father-in-law had beaten her with a bat, the CJI-headed bench said, “It doesn’t matter if your father or you used to hit him with a bat.” When a woman gets hurt in the in-laws, the primary responsibility is that of the husband. The bench then dismissed the man’s plea. Please tell that earlier the Punjab and Haryana High Court also refused to give anticipatory bail to her husband.
