Elgaar Parishad Case | Supreme Court Grants Bail to Elgaar Parishad Case Detainees; Vernon Gonsalves and Arun Ferreira

Pune: Elgaar Parishad Case | In a significant development, the Supreme Court has granted bail to Vernon Gonsalves and Arun Ferreira, who were both detained in connection with the Elgaar Parishad case in Pune. “it grants bail to Gonsalves and Ferreira while considering that almost 5 years lapsed since they were taken into custody. There is a case for bail,” the hon’ble SC observed. However, while awarding bail to the defendants, the court imposed certain conditions to ensure their compliance with the investigation.

 

The Conditions are as follows:
1. The court directed Gonsalves and Ferreira not to move out of Maharashtra and to surrender their passports as part of the bail conditions.

2. Additionally, the two must restrict their mobile phone usage to only one device and keep the National Investigation Agency (NIA) informed about their whereabouts at all times.

The court emphasized that their mobile phones should remain charged round the clock so that the NIA can easily communicate with them and monitor their addresses. Any violation of these conditions may lead to bail cancellation, as urged by the investigative agency.

Previously, both defendants had sought bail from the Bombay High Court, but their pleas were denied, prompting them to approach the Supreme Court. After hearing arguments from both parties, the Supreme Court reserved the decision, which was finally granted on Friday 28th July.

The Elgaar Parishad case came to the fore after Pune City Police conducted an investigation into the gathering held on December 31, 2017, at Pune’s Shaniwarwada. The police suspected the gathering of having Maoist links and claimed that it incited violence in Koregaon Bhima on January 1, 2018, leading to community conflicts resulting in one fatality and several injuries.

 

 

Authorities asserted that Gonsalves and Ferreira were associated with the outlawed Maoist organization and were involved in its activities. Subsequently, the investigation was handed over to the National Investigation Agency (NIA).
