Developers responsible for delays in housing projects, Reasons for delay in permits rejected

Mumbai: There is no reason to change the policy of the municipality or delay the work of the housing project due to non-receipt of necessary permits. Developers have a thorough knowledge of the area and an idea of the potential dangers before starting the project. Therefore, it is not appropriate to hit home buyers with project delays, MahaRERA clarified in an order. So the investor ordered the developer to pay interest on the amount paid until the house was acquired.

Faim Qazi had registered a house in the Vision Heights project in Andheri in April, 2014. He had paid Rs 67 lakh 52 thousand. According to the agreement, he was to get possession of the house by December 31, 2018. However, when he didn’t not get it, he rushed to MahaRERA.

He received IOD for the project in July, 2010. However, after that the policy of Fungible FSI changed and the plans of the buildings had to be changed. After that, permission for the last four floors of the 23-storey building was delayed due to lack of NOC from the Airport Authority. NOC received it in January, 2019. After the new development plan was approved by the Mumbai Municipal Corporation in September, 2018, it was forced to provide some of the houses in the project free of cost.
