Pune: An aunt of the child in conflict with law (CCL) in the hit-and-run case has filed a petition in the Bombay High Court alleging that the police have illegally detained him and they are snooping on her family.

The CCL, minor son of builder Vishal Agarwal, allegedly under the influence of alcohol, drove his father’s Porsche car recklessly and caused the deaths of two IT engineers that took place in Kalyani Nagar on May 19. He is lodged in an observation home and his parents and some other people have been arrested for trying to shield him.

The plea filed on June 10 was heard on Friday before a bench of the High Court comprising Justice Bharati Dangre and Justice Manjusha Deshpande.

In her petition, the CCL’s aunt has alleged that the police are being distracted from investigating the case due to political agenda and public anarchy. The Juvenile Justice Act has also been violated.

Wrong image of the family

The plea alleged, “A false picture has been portrayed about the family of the CCL. He has been put under house arrest even though being a minor, which would be detrimental to him.

“His custody should be given to a family member who can take care of him. He should not be lodged in an observation home.”

Petitioner’s lawyer Abad Ponda demanded immediate release of the CCL. Public Prosecutor representing the Pune Police challenged the petition saying the CCL is in legal custody at the observation home.
