Pune : Father gets 30 years of jail for repeated sexual assault with daughter

Pune: 37-year-old Kondhwa resident convicted and sentenced a to 30 years of rigorous imprisonment for repeated sexual assault on his 15-year-old daughter for more than a year before October 2019 by a special fast track court for POCSO Act.

The 37-year-old father, originally from Uttar Pradesh, living in Kondhwa Khurd, has been sentenced by the special fast track court. Besides, a fine of Rs 15,000 has also been imposed on him.

Strict action was demanded by the special public prosecutor Arundhati Bramhe. The medical testimony, the witness of the investigating officer Assistant Police Inspector Swaraj Patil and the testimony of the victim with the first class judicial officer are important to prove the crime. Police handler Sachin Shinde and police shipkeeper Ankush Kangge helped a lot in court work.

The minor had lodged an FIR with the Kondhwa police station on October 21, 2019, stating that she was repeatedly subjected to sexual harassment at first as her father would touch her inappropriately. Later, she said her father sexually assaulted her. Her father first time committed the rape in June 2019. Frustrated by the repeated assaults, the girl narrated her woes to her mother on August 11, 2019. When the mother confronted the accused, he threatened and assaulted her and his daughter.

The victim has four sisters, brothers, parents all living in Kondhwa. She studies in class 8. The accused father raped the victim for almost one year. The accused had threatened not to disclose this to anyone. After this, her school started in June. During this time the father again raped the victim when there was no one in the house.

The girl became pregnant after repeated rape. She suddenly got miscarriage. Then on October 10, 2019, he tried to rape the girl while she was sleeping next to her mother. Both mother and daughter were beaten up by the man for protesting. The mother then filed a complaint.

The court imposed 30 years of hard labour and fine of Rs 10,000 under Section 4 of the Prevention of Child Sexual Offenses Act (PASCO), 1 year hard labour under 323 (assault), 6 months hard labour under 506 (bullying), 5 Years of hard labour and a fine of Rs 5,000 under POSCO 8, POSCO 12.
