Pune police approach city court to get extension in Elgaar Parishad

The Pune police have approached the Special Judge K D Wadane praying for giving additional time to file charge sheet in the Elgaar Parishad case.

On completion of 200 years in the Battle of Koregaon Bhima on December 31,  2017 Elgar Parishad was held in Shaniwarwada in Pune. Shaniwarwada which is historical and headquarter of Peshwa. Such Parishad Gujarat MLA Jigesh Mewani, former JNU students was part of it.  Due to inflammatory and provocation speeches, due to the distribution of literature, riots broke out on January 1, 2018, at Koregaon Bhima held the investigation.

Such case was registered with Vishrambaug police station which falls under the jurisdiction of Pune city police against the organizers of the Elgar Council against Tushar Damgade, alleging that the Maoist think-tank has a hand in hand.

On April 17, Pune police teams raided the Pune, Nagpur, Mumbai, and Delhi raiding the spot. In it, Sudhir Dhawale, Harshali Potdar, Nagpur based lawyer Surendra Gadling, Rona Wilson in New Delhi, and Sagar Gorkha of Kabir Arts Forum at Wakad in Pune, and Ramesh Gaychore of Yerawada Lakshminagar were house were raided on the same day and the police had procured some literature, hard disk, and some bank transaction.

Police had seized important documents, Pen Drives, hard-disk and other incriminating material.

Pune city police had on June 6 arrested New Delhi based Rona Wilson, From Mumbai police arrested Sudhir Dhawale Shoma Sen and Mahesh Raut while from Nagpur police picked up Surendra Gadling for organizing the Parishad, which cops claim contributed to the Bhima Koregaon violence in January. As on September 3, 90 days will be completed in this case and police need to filed charge sheet in this case or else failure to filing the charge sheet the arrested person can be released on bail. But under the provision laid down under The Unlawful Activities (Prevention) Act, such extension of charge sheet can be filed by 180 days.

On Friday, the Pune officer submitted an application before Judge Wadane pleading and permitting them to give the additional time of 90 days to file the charge sheet under the provision laid down under The Unlawful Activities (Prevention) Act. Based on which the extension of increasing and allowing the officer to file the charge sheet be increased will be heard in court on Sunday 10 am by Judge Wadane.

On Saturday morning Sen along with Advocate Gadling, Sudhir Dhawale, Rona Wilson and Mahesh Raut were brought in court under heavy police bandobast.

Also, appeal if such matter can be heard on Saturday evening.”

But defense lawyers Rahul Deshmukh and Rohan Nahar argued for soughing time and pointed out to the court that such prior intimation of the application was not given to them and this is negligence. There is defibrate attempt of police hide such facts from us and this is a violation of Human rights.”

Speaking to media ACP Pawar on PIL filed against Pune police and such investigation to handover to National Investigation Agency (NIA) he said, “Our investigation is on the right direction and we are still investigating. Under UAPA act ACP and above ACP rank can investigate the case.”

In the meantime, the arrested person Surendra Gadling moved an application claiming that Pune Yerawada Central Prison is violating the court order as 16 different articles despite the court orders he was not given in prison including Law books, Law journals, few books related to political science and others. The later court on Saturday reordered and directed the prison to handover the various books including the law manual demanded by Adv Gadling.
