According to the FIR filed at the Vita police station, complainant Deshmukh got to know Nitin Shah in 2015, when the former was hospitalised in Pune. Bartakke used to accompany Shah during visits to Deshmukh. Bartakke took the power of attorney from Desai of the land at Parvati in August 2017. They promised Deshmukh to triple the investment on this land within three months and demanded around Rs 4 crore for various purposes to develop the land. They also promised to give a new luxury car to Deshmukh.

He told them that he did not have so much money. They asked him to borrow money from acquaintances in Mahuli village. The complainant and other villagers saw the 49-guntha land at Parvati. A board was put up at the plot that it belonged to Nilmani Dhairyashil Desai. Encroachers on the land were given a legal warning. Then Deshmukh agreed to invest money. Thus, Deshmukh gave Rs 1.51 crore while 12 others gave Rs 1.77 crore to Bartakke and Shah. Bartakke handed over his luxury car to Deshmukh. Later, he came to know that it was taken on a loan from State Bank of India.

Later, Deshmukh and other investors demanded refund of their money from Shah and Bartakke. The accused sent them an advertisement published about the land in the newspaper. They told Deshmukh that they would sell the land to Dadhe and arranged a meeting with the builder. They told Deshmukh and others that they would give good returns on their investment after their deal with Dadhe is finalised. However, the accused did not give money to the complainant till date. Hence, Deshmukh finally approached the police and lodged the complaint.
