National Green Tribunal fines Ekta Housing Rs 15 crore 99 lakh for violating laws

Ltd | The National Green Tribunal (NGT) has imposed a fine of Rs 15 crore 99 lakh on Ekta Housing Pvt Ltd for not taking permission of MPCB and continuing with illegal construction. Ekta Housing has a housing project at Undri and it has violated the laws. The NGT has said that the company should pay the fine and restore the environment to the earlier condition before starting the work on the project. The company has been told not to use borewell water and DG set till it gets the permission from the required department.

 

Ekta Housing Company has a residential project Ekta California in Undri village in PMC limits. The company had taken first permission of the PMC in 2007 for starting the project. After taking the permission, the company made seven changes in the project and carried out more construction. The project was spread over an area of more than 20,000 square metres and although it is mandatory to take prior permission from MPCB, it was not taken and the company illegally continued with its illegal construction.

 

Environmental activist Tanaji Gambhire with the help of Adv Nitin Lonkar and Adv Sonali Suryavanshi approached the NGT. It admitted the plea in August 2019. In October 2019, a committee of environmental experts and MPCB experts was set up. The NGT directed the committee to submit a report mentioning the status of the project. The committee submitted a report in January 2020 to the NGT.

 

MPCB submitted an affidavit on January 28, 2022 which mentioned that an environmental damage of Rs 15 crore 99 lakh had been done. Ekta Housing Company submitted an affidavit seeking the quashing of the complaint. During the final hearing, the NGT rejected the arguments of the company and asked it to pay a sum of Rs 15 crore 99 lakh for damaging the environment.
