Hoarding owner claims its not my fault but railways fault and negligence in Juna Bazaar case

The illegal hoarding in Pune based busy area fell down in which three people died while six people are injured on Friday afternoon has shook the city. The police are claiming its due to illegal and negligence’s of the  owner of such hoarding but when contacted the owner he claims that Railway is responsible for the act and not him.

On Friday on the busy road a huge iron hoarding fall down on the Shahir Amar Shaikh Chowk near Junna Bazar in which three people died while six people were injuried. The team of police and fire bridge rushed to the spot.

Shyamrao Gangadhar Kasar (70), Pimpale gurav,  Shyam Rajaram Dhotare (45). Madina Mapzar in Dehu cantonment and Shivaji Devdas Pardeshi (40), Nana Peth.

The names of injured are Shivaji Devidas Pardeshi (40), Kiran Somnath Thosar(22), Yashwant Rama Khobare, Mahesh Auchekar, Rukmini Pardeshi. – all are undergoing treatment at Sassoon hospital.

According to police, “in the railway premises such hoarding was placed and process of removing such hoarding was going on. Under the cutting process it seem such hoarding was cut from base inside from upside due to which the entire hoarding fall down on the road and apparently the signal was left on such busy road and it fall on the people. Immediately the rescue operation had began and some ten people were rescued while three died, seven are injured.”

  When contacted the hoarding Captions Outdoor Advertising via his partner Abdul Razzak Faquih issued a released  mentioning, “It is submitted that, Captions Outdoor Advertising had been allotted a tender of commercial publicity for Sole Advertisement Rights for Zone – C, Juna Bazaar Chowk, by the Railways for a period of 7 years on 16/12/2015. The Railway Department, on 16/06/2017 directed the firm to conduct Structural Audit of the hoardings from the government authority. On 21/07/2017, the firm approached the College of Engineering for the Structural Audit Report and have paid all the fees for the same. In the meantime, on 16/11/2017, the Railway Department directed to remove all the display plywood vinyl sheets from the site.”

It went on, “The firm removed all the displays & hoarding boards till date. It is submitted that, in November, 2017, after removal of the flexes and boards from the said structure the firm has not displayed any single flex on the said structure. The firm, there-after, on 29/11/2017 gave a 90 days’ notice for termination of tender contract to the railway. On 04/12/2017, the firm requested permission to remove structures of all the hoardings. On 13/12/2017, the firm again requested to give permission to remove structures of all the hoardings. The firm also informed to the Railway Authorities by letter dated 11/04/2018, that the local political parties are using the said structure for birthday and festival greetings and have also requested to remove and dismantle the structure. That on 14/05/2018, Sr. DCM C.Rly, Pune, addressed a letter to Sr. DEN (Co), C. Rly, Pune, directing them to dismantle by Railways Engineering Department. Copy of which was received by Captions Outdoor Advertising on 14/05/2018.”

It added, “That on 12/07/2018, the Railway Authorities started the dismantling of structures from the said site of Juna Bazaar. It is submitted that, on 06/08/2018, the Railway Authorities removed haphazardly, the back support of the structure which weakened the structure. The said work was kept incomplete by the department. Due to the removal of support, the structure had become weak which resulted into the falling of structure causing the mishap. It is learned that today also the Railways / its structure removing agency was working on the site to remove the remaining structure and the part of the structure fell down while they were working. It is also learned that the Railways had removed part of the compound wall in order to make a concrete wall and this may also have weakened its foundation. It is submitted that, the firm has also filed an application before the District Judge, Pune, against the Railway Authorities.”
