Cancel the anticipatory bail of builder Karnataki plea

Two months after the Bombay High Court granted an anticipatory bail to builder Sudhir Karnataki, who along with NCP corporator Deepak Mankar and others, is facing charges of abetting real estate agent Jitendra Jagtap to commit suicide. On Wednesday an petition was moved in HC for cancelling his anticipatory bail.

The HC had earlier rejected Mankar’s pre-arrest bail plea and the Supreme Court too dismissed his petition, giving Mankar was asked by August 2 to surrender before the police and now he is at schedule cell at Yerawada Central Prison.

In Karnataki’s case, the bench prior granting anticipatory bail pleas had observed in an order on July 26, “There is prima facie evidence against the co-accused Deepak Mankar and, therefore, his application was rejected. However, the case of the applicant-accused (Karnataki) and the co-accused on this point, prima facie, stand on a different footing.”

Both, Mankar and Karnataki, are accused of harassing and presurrising Jagtap to hand over possession of a plot in Rasta Peth. On June 2, seven to eight unknown persons along with co-accused Vinod Bhole threatened Jagtap and his son Jayesh. Around 1pm the same day, Jagtap committed suicide.

On Wednesday, the complainant Jayesh Jitendra Jagtap via his lawyer Satyavrat Joshi had moved an application for cancelling Karnataki anticipatory bail pleas. Such hearing is at pre-admission stage and Justice Anuja Prabhudesai has adjourned and on January 24, 2019 such will be heard.

Referring to Jagtap’s suicide note, the earlier bench while granating bail had observed although Karnataki’s name is mentioned, the deceased has specifically mentioned that co-accused Mankar was the cause for his death.

The prosecution had argued that Karnataki gave a letter to the Kothrud police on June 2 stating that Jagtap had threatened to commit suicide. This was mentioned in his anticipatory bail plea before the sessions court.
