Nirbhaya Case : Way of Convict Mukesh’s Hanging Cleared, SC Dismissed Appeal on Mercy Petition
New Delhi : NpnAnother plea of Mukesh Singh, convicted of the Nirbhaya Gang Rape Case, has been dismissed in the Supreme Court. On sexual assault in jail, SC said that ‘Torture’ in jail cannot be ground to review Prez Order. The court found all his arguments baseless. The court dismissed the petition, saying that torture in jail cannot be the basis for reviewing the president’s decision to dismiss the mercy petition.
Justice R. Bhanumati, Justice Ashok Bhushan and Justice AS. The Bopanna Bench said that the President’s early disposal of mercy petition does not mean that he did not take a conscious decision. The bench said that relevant records including the trial court, High Court and Supreme Court verdicts in the Nirbhaya case were presented to the President by the Ministry of Home Affairs. The court also said that facing the alleged suffering in jail cannot be made a basis against the President’s dismissal of the mercy petition.
Earlier on Tuesday, the court heard the arguments of both sides. Mukesh’s lawyer Anjana Prakash claimed that Mukesh was sexually abused in jail and his brother Ram Singh was killed. During this time, jail officials were also present, but they did not say anything. Lawyer Anjana Prakash had said that many documents were not kept in front of the President, so the Supreme Court should consider against the mercy petition being rejected. After hearing both the sides, the court had reserved the verdict till Wednesday.
While passing the verdict today, the Supreme Court said, ‘To confirm, we looked at all the documents sent to the President. The Home Ministry had sent all the documents. There is no merit in Mukesh’s petition. Harassment in jail is no basis for mercy.” After this, Mukesh’s petition was dismissed.
With the dismissal of this petition, the way of Nirbhaya convict Mukesh Singh’s hanging has been cleared; Because after reconsideration petition, curative petition and mercy petition were rejected, he had only option left to challenge the decision of Rashtrapati Bhavan in the Supreme Court. This last option is also over after the petition is dismissed.

Akshay Singh Thakur, another convict of Nirbhaya has filed a curative petition in the Supreme Court. After Akshay, Vinay is also going to send a mercy petition to the President today. The four convicts Mukesh Singh, Pawan Gupta, Akshay Kumar Singh Thakur and Vinay Sharma have been sentenced to be hanged for the 2012 Nirbhaya gang rape case in Delhi. All of them are to be hanged in Tihar Jail at 6 am on February 1.
